A report in the National news media on the 18th December 2018 that a certain celebrity has been charged with an alcohol-related motoring offence has illustrated that this is the period for the Drink/Drug Driving Campaign launched by the National Police Chiefs’ Counsel on the 1st December and lasting until the 1st January 2019.
A conviction for drink driving or drug driving has serious consequences; there will be a mandatory disqualification from driving for at least 12 months, and another penalty ranging from a fine to a custodial sentence, both increasing in severity according to the reading and any previous similar matters.
There is a level for alcohol below which a prosecution would be unlikely; the limits for drug driving are set at a zero tolerance level. in any event, it takes time for the system to eliminate what has been consumed. Often, drivers are prosecuted for what has been consumed on the evening before they are stopped when they have consumed alcohol or sometime before when drugs remain in their system.
If you are investigated or charged with such an offence, we can assist and will be pleased to discuss your case generally, and in particular, whether Legal Aid will be available to you.
